The Intercept Survey T-Shirt Sweepstakes: Official Rules

NO PURCHASE NECESSARY TO ENTER OR WIN. A PURCHASE OR PAYMENT OF ANY KIND WILL NOT INCREASE YOUR CHANCES OF WINNING.

Eligibility: Open only to legal residents of the 50 United States and the District of Columbia who are at least 18 years old or the age of majority in their state of residence, whichever is older. Employees of First Look Institute (“Sponsor”) and of its parents, subsidiaries, and affiliates and of any third parties involved in the development or administration of this Sweepstakes (collectively, the “Sweepstakes Entities”), as well as the immediate family (spouse, parents, siblings, and children) and household members of each such employee are not eligible to participate in the Survey Sweepstakes (the “Sweepstakes”). Participation constitutes entrant’s full and unconditional agreement to these Official Rules and Sponsor’s decisions, which are final and binding in all matters related to the Sweepstakes. Void where prohibited.

Timing: The Sweepstakes begins at 12:00 AM Eastern Time (“ET”), August 1 2021, ends at 11:59 PM ET, September 30 2021 (the “Sweepstakes Period”).

How to Enter: Eligible entrants should complete and submit the Intercept Newsletter SubscriberSurvey to be automatically entered. There are no “correct” answers to the survey questions, but your contact information must be accurate and complete. Limit one entry per person and per device ID. Entries that exceed the limit will be void, if discovered by Sponsor Use of any automated system to submit entries is prohibited and will result in disqualification if discovered by Sponsor. Sponsor reserves the right in its sole discretion to disqualify any entry at any time that in Sponsor’s opinion does not comply with these Official Rules. Incomplete entries will be disqualified. Sponsor is not responsible for entries that are lost, late, deleted, garbled, damaged, misdelivered or misdirected. Ordinary internet access and similar charges apply. All received entries become the property of Sponsor and will not be returned. If there is a dispute regarding the identity of an entrant, the holder of the email account associated with the entry will be deemed the person who submitted the entry. Proof of sending or submission will not be deemed to be proof of receipt by Sponsor.

Winner Selection, Notification, and Verification: After the close of the Sweepstakes Period, fifty (50) eligible entrants will be selected by random drawing from among all eligible entries. Odds of winning depend on the number of eligible entries. Entrant selected must comply with all terms and conditions of these Official Rules, and winning is contingent upon fulfilling all requirements. Sponsor will attempt to contact winner by email. Potential winners may be required to sign and return to Sponsor, an affidavit of eligibility and provide requested identification in order to claim a prize. If potential winner does not respond within 72 hours after the first attempt to contact potential winner, if potential winner fails to sign and return required documents and provide required identification by the deadlines set by Sponsor, if potential winner is not in compliance with the Official Rules (including eligibility requirements), or if potential winner declines the prize, Sponsor may select an alternate winner by random drawing from remaining eligible entries, time permitting.

Prize: A “The Intercept” t-shirt, approximate retail value, $20. Prize is nontransferable, and there are no substitutions except at the discretion of Sponsor. Prize will be mailed to verified winners. Sponsor not responsible for loss, delay, or damage in delivery. All expenses not expressly stated above will be the sole responsibility of winner, including but not limited to any government taxes. Properly claimed prize will be awarded, but in no event will Sponsor award more prizes than are provided for in these Official Rules.

General Conditions: Sponsor reserves the right in its sole discretion to disqualify any individual it finds to be tampering with the entry process or the operation of the Sweepstakes or to be acting in violation of these Official Rules, or in an unsportsmanlike or disruptive manner. If a dispute arises regarding compliance with these Official Rules, Sponsor may consider, in its sole discretion, data reasonably available to Sponsor through information technology systems in Sponsor’s control, but Sponsor will not be obligated to consider any data or other information collected from any other source. Sponsor’s failure to enforce any term of these Official Rules will not constitute a waiver of that provision. If there is any conflict between any term of these Official Rules and any of the entry or marketing materials used in connection with the Sweepstakes, the terms of the Official Rules will govern.

Release: By entering this Sweepstakes, entrant agrees to release and hold harmless each of the Sweepstakes Entities and each of their respective officers, directors, employees, and agents (collectively, the “Released Parties”) from and against any claim or cause of action including, without limitation, personal injury, death, or damage to or loss of property, arising out of participation in the Sweepstakes or receipt or use or misuse of the prize.

Limitations of Liability: The Released Parties are not responsible for: (i) any incorrect or inaccurate information, whether caused by entrants, printing errors or by any of the equipment of programming associated with or used in the Sweepstakes; (ii) unauthorized human intervention in any part of the entry process or the Sweepstakes; (iii) technical or human error that may occur in the administration of the Sweepstakes or the processing of entries; or (iv) lost, late, incomplete, invalid, unintelligible, or misdirected entries. If for any reason an entrant’s entry is confirmed to have been erroneously deleted, lost or otherwise destroyed or corrupted, entrant’s sole remedy is another entry in the Sweepstakes, provided that, if it is not possible to award another entry because of discontinuance of the Sweepstakes, or any part of it, for any reason.

Disputes: Entrant agrees that: (i) any and all disputes, claims and causes of action arising out of or connected with this Sweepstakes or the prize awarded must be resolved individually, without resort to any form of class action, and exclusively by the appropriate federal or state court located in the County of New York, New York; (ii) any and all claims, judgments and awards will be limited to actual out-of-pocket costs incurred, including costs associated with entering this Sweepstakes but in no event attorneys’ fees; and (iii) under no circumstances will entrant be permitted to obtain awards for and entrant hereby waives all rights to claim indirect, punitive, incidental and consequential damages and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased. SOME JURISDICTIONS DO NOT ALLOW THE LIMITATIONS OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE MAY NOT APPLY TO YOU. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of the entrant and Sponsor in connection with the Sweepstakes, will be governed by, and construed in accordance with, the laws of the State of New York, without giving effect to any choice of law or conflict of law rules (whether of the State of New York or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than the State of New York.
